BESTIES – General Terms and Conditions (GTC)
1. Scope and General Provisions
1.1. All contracts are concluded between Gündüz & Vokshi OG (hereinafter “Besties”) and the participants.1.2. The boxing studio is located at Mariahilfer Straße 115/31c, 1060 Vienna.
1.3. These GTC apply to all contracts regarding services provided by Besties, in particular training, course, and workshop offers.
1.4. By checking the respective box during online booking (via Eversports or the website), participants agree to these GTC.
2. Use of Facilities and Participation in Classes
2.1. Use of the facilities is only permitted during current opening hours and in compliance with the house rules (see Section 3).2.2. Participation in classes is only possible with punctual arrival at the announced start time.
2.3. Studio staff may issue instructions if necessary to prevent danger, avoid damage, or prevent disturbances. These instructions must be followed.
2.4. In cases of misconduct (e.g., insults, threats, theft, sexual harassment, lack of hygiene, etc.), access to the studio may be refused or permanently denied.
2.5. Participation in classes is only permitted from the age of 18.
3. House Rules
3.1. All areas of the studio must be kept clean. Waste must be disposed of properly.3.2. Training equipment may only be used appropriately and treated with care.
3.3. Unnecessary noise, harassment, or disturbances caused by mobile phones or other devices must be avoided.
3.4. Consumption of alcohol, drugs, or medication that impairs reaction time is prohibited before and during classes.
3.5. Photo and video recordings of other participants are only permitted with their prior consent.
3.6. In case of injury to other participants, all participants are obliged to provide reasonable assistance and first aid.
3.7. The boxing studio is a no-street-shoes zone – street shoes must be removed and placed in the designated area.
3.8. Training rooms may only be entered with clean sports shoes and appropriate sportswear.
3.9. Jewelry, watches, hair clips, and similar items must be removed before training. Fingernails and toenails must be kept short to prevent injuries.
3.10. In all wet areas, suitable bathing shoes must be worn for hygiene and safety reasons. After showering, changing rooms may only be entered once dried off.
4. Health and Personal Responsibility
4.1. Participants confirm that they do not have any contagious diseases and are physically able to take part in classes.4.2. Participation is at one’s own risk. Studio staff are not obliged to verify suitability.
4.3. Injuries, surgeries, chronic conditions (e.g., back problems), and pregnancies must be disclosed before starting.
4.4. Liability for health disadvantages is excluded, except in cases of intent or gross negligence by studio staff.
5. Contract Terms, Prices, and Payment
5.1. Contracts are concluded by booking via Eversports, the Besties website, or in writing at the studio.5.2. By clicking “order with payment obligation,” the participant submits a binding contractual offer. The contract is concluded upon confirmation by email.
5.3. Offers, prices, and services are listed on Eversports or the website.
5.4. Class passes and memberships are personal, non-transferable, non-extendable, and non-refundable in cash.
5.5. No credit or refund is granted for unused classes.
5.6. Trial offers are one-time only and available to new customers.
5.7. Membership fees and payment terms are based on the contract sheet.
5.8. Price changes will be communicated in writing two weeks in advance.
5.9. Payment is made exclusively via the online booking system (Eversports) or by SEPA direct debit, before the start of the class.
5.10. In case of late payment, reminder and processing fees may apply.
6. Contract Duration, Termination, Suspension
6.1. Contract models:10-Class Pass: 10 classes within 2 months from the first class.Monthly Membership (no binding period): Unlimited classes per contract month, cancellable at the end of the month with 1 month’s notice.Annual Membership: Minimum term of 12 months, then cancellable monthly with 1 month’s notice.6.2. If not terminated, the contract is automatically extended.
6.3. Extraordinary termination is possible in the event of relocation (over 30 km), injury/illness (longer than 1 month, with medical certificate), or pregnancy.
6.4. Suspension of membership is possible in case of illness/injury, max. 6 months per year, not retroactive.
6.5. Termination must be made in writing, including name and date of birth.
7. Cancellations and Rebookings by Participants
7.1. Cancellation of open classes must be made on time via Eversports.7.2. Later cancellations will be fully charged.
7.3. No entitlement to refunds in case of early termination.
8. Execution, Cancellation, and Changes by Besties
8.1. Participation cannot be guaranteed, as capacities are limited.8.2. In case of cancellation or rescheduling, a full or partial refund will be made.
8.3. Changes in course content with the same overall character do not entitle participants to withdraw.
9. Data Protection
9.1. Personal data will be processed in accordance with GDPR (see privacy policy).9.2. Photo and video recordings may be used for marketing and community purposes.
9.3. Participants may object to publication at any time.
9.4. Video surveillance only in publicly accessible areas, clearly marked. No recordings in changing rooms or sanitary areas.
10. Right of Withdrawal
10.1. For online purchases, a statutory 14-day right of withdrawal applies (§ 18 FAGG).10.2. Classes attended within this period will be charged proportionally.
10.3. No right of withdrawal applies to drop-in or trial classes (§ 18 Abs. 1 Z 10 FAGG).
10.4. Withdrawal may be submitted informally or using the attached form.
11. Liability and Compensation
11.1. Liability for property and financial damages only applies in cases of intent or gross negligence.11.2. Courses are not a substitute for medical advice or treatment.
12. Final Provisions
12.1. Participants must provide correct information upon contract conclusion and promptly notify of any changes.13. Changes to the GTC
13.1. Changes will be communicated in writing in due time and are deemed accepted if no objection is raised within 4 weeks.14. Severability Clause
14.1. Invalid provisions do not affect the validity of the remaining terms.15. Jurisdiction and Applicable Law
15.1. Austrian substantive law applies, excluding conflict of law rules. Contract language is German.15.2. Jurisdiction is Vienna, except for claims against consumers under § 14 KSchG.
